US SUPREME COURT: Law prohibiting video game sales to kids rejected
WASHINGTON - The U.S. Supreme Court on Monday struck down a California law prohibiting the sale of violent video games to minors, delivering a major victory to the nation's gaming industry and a blow to lawmakers, advocates and child health experts who argued for greater restrictions.
In a 7-2 decision, the high court said the statute -- passed in 2005 but never enacted -- violates First Amendment protections afforded to books and television shows, and that proponents of the law failed to show that gory games have harmful effects on kids.
Reading the majority opinion, Justice Antonin Scalia pointed to violent episodes in classics like Hansel and Gretel, Lord of the Flies and Homer's Odyssey, as well as comic books and Saturday-morning cartoons. All previous attempts to ban such violence were unsuccessful.
No causal link
"In truth, the California Act is the latest in a long series of failed attempts to censor violent entertainment for minors," Scalia said. "California has not demonstrated any direct causal link between playing violent video games and actual harm to minors."
Gov. Arnold Schwarzenegger, the star of many violent action films, signed the 2005 measure penned by former Assemblyman Leland Yee, D-San Francisco.
"You have the Supreme Court siding with corporate America...against our children and against the people of the state of California," Yee, who is now a state senator, said Monday in Sacramento. He said supporters likely would try to craft new legislation that would meet the court's objections.
Under the law, retailers would be have been banned from selling minors any games "in which the range of options available to a player includes killing, maiming, dismembering or sexually assaulting an image of a human being." The law sought to require "18-and-over" stickers for the bloodiest games and $1,000 fines for stores that sold them to children.
Industry ratings
Groups representing roughly 300 retailers operating about 40,000 stores challenged the law as unconstitutional and maintained that the industry's self-imposed rating system is already keeping the most violent games out of the wrong hands.
